Georgia DUI Laws and Drunk Driving Information


The legal blood alcohol content (BAC) limit in the state of Georgia is .08. If you are caught driving with a blood alcohol content higher than .08 you are considered legally drunk. To be charged with a DUI, you must either have an unlawful blood alcohol level or any amount of contraband drugs. Most people believe that you have to have a blood alcohol content of .08 in order to be convicted of a Georgia DUI, this is not true. If an arresting officer deems that you are driving erratically or otherwise unsafe you can still be taken to jail for DUI regardless of your BAC.

If you are under 21 years of age and your breath test reads .02 or higher it is considered a "per se" violation of the Georgia DUI laws.
