First Ohio
DUI Offense:Fine: $300.00 - $1,500.00
ALS: License suspended for 90 days for .10% BAC [link to bac def] or above OR License suspended for one year for test refusal.
Jail Time: Minimum of 3 consecutive days or a three-day driver intervention program.
Court License Suspension: Can range from 6 months to 3 years
Second Ohio DUI Offense Plus:
Fine: $200.00 - $1,000.00
ALS: License suspended for 1 year for .10% BAC [link to bac def] or above OR License suspended for two years for test refusal.
Jail Time: Minimum of 10 consecutive days or five days plus a minimum of 18 consecutive days of house arrest (EMHA), up to a maximum of six months. Could also be required to go to Discretionary driver’s intervention program.
Vehicle: Your vehicle could be immobilized and your plates impounded for 90days
Court License Suspension: Can range from 1 year to 5 years
Third Ohio DUI Offense:
Fine: $500.00 - $2,500.00
ALS: License suspended for 2 years for .10% BAC [link to bac def] or above OR License suspended for three years for test refusal.
Jail Time: Minimum of 30 consecutive days up to one year or 15 days of jail time plus a minimum of 55 consecutive days of house arrest (EMHA), combined to make up a maximum of one year. Will be required to go to alcohol treatment program paid for by the defendant.
Vehicle: You could be required to forfeit your vehicle if this is your 3rd DUI conviction in a six year period.
Court License Suspension: Can range from 1 year to 10 years
Fourth+ Ohio DUI Offense or Vehicle Related Felony Conviction:
Fine: $750.00 - $10,000.00
ALS: License suspended for 3 years for .10% BAC [link to bac def] or above OR License suspended for five years for test refusal.
Jail Time: Minimum of 60 consecutive days up to one year. Will be required to go to alcohol treatment program paid for by the defendant.
Vehicle: Mandatory forfeiture of the vehicle being operated during the offense.
Court License Suspension: Can range from 3 years to permanent license suspension
